and plus malfoy at the time was always seen by the teachers as a kid that wasn't all that bad... vain and overly dignified maybe but not necesarily a bad kid. and at the time i would even think harry, hermione and ron had soemthing to do with it cause they were right there at the crime scene happened and they were always wandering about.
